General Terms and Conditions
The webshop of DIRKDUPRESCULPTURES, a Belgian company with registered office at Rommelsweg 39 - 9980 Sint-Laureins Belgium, VAT BE 0711.445.807, offers customers the opportunity to purchase the sculptures online. The sculptures are purchased through this webshop and shipped to the purchaser through a designated shipping company.
These General Terms and Conditions apply to every order placed by a visitor to this webshop. When placing an order via the webshop, the customer must expressly accept these Terms and Conditions, thereby agreeing to their applicability, to the exclusion of all other conditions.
Additional terms and conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by DIRKDUPRESCULPTURES.
Cost prices
All prices stated are expressed in EURO, including VAT. The customer will be informed if there are delivery, reservation or administrative costs, duties or taxes.
For example, orders coming from outside the European Union may be subject to customs fees. These differ from region to region.
The price statement applies exclusively to the items as described verbatim.
The applicable VAT rate of 6% applies as stated in Royal Decree no. 20, Table A, Section XXI, §1.
The customer has a choice between the payment methods offered in the webshop: via credit card, bank card or bank transfer.
By placing an order, the customer agrees to these general terms and conditions.
The accompanying photos are decorative and may contain elements that are not included in the price.
DIRKDUPRESCULPTURES is authorized to refuse an order if there is a suspicion of fraudulent behavior or copying behavior as well as in the event of serious shortcomings on the part of the customer with regard to orders in which the customer is involved.
The purchased sculptures will be shipped after receipt of the scheduled payment.
Content and offer
Despite the fact that the online catalog and the webshop have been compiled with great care, it is still possible that the information provided is incomplete, contains limited material errors or is not up to date. Obvious mistakes or errors in the offer do not bind DIRKDUPRESCULPTURES.
DIRKDUPRESCULPTURES is only obliged to make an obligation of means with regard to the accuracy and completeness of the information provided. DIRKDUPRESCULPTURES is under no circumstances liable in the event of manifest material errors, typesetting or printing errors.
If the Customer has specific questions about the sculptures, availability, delivery time or delivery method, we request the Customer to contact DIRKDUPRESCULPTURES in advance by e-mail. The offer is always valid while stocks last. DIRKDUPRESCULPTURES cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.

Orders always end up in a shopping cart that the customer can consult and adjust if desired. Payment will be requested to complete the order.
As soon as your order has been placed, the customer will receive an email confirming the order. DIRKDUPRESCULPTURES is entitled to refuse an order due to a serious shortcoming by the Customer with regard to orders in which the Customer is involved.
Shipping and returns policy
After receipt of payment, the product will be sent via a courier service indicated on the webshop, within 7 working days unless otherwise stated on the website. DIRKDUPRESCULPTURES cannot be held liable for any delays in delivery. Delivery costs are included and shown separately when purchasing via the webshop.
DIRKDUPRESCULPTURES sculptures are available within the European Union as well as abroad.
For purchases and deliveries outside the European Union, an appointment is required by e-mail.
Unless otherwise agreed or expressly stated otherwise, the goods will be delivered to the customer's place of residence within 30 days after receipt of the order via the webshop.
Any damage and/or qualitative shortcoming of an item or other shortcoming in delivery must be reported by the customer immediately to DIRKDUPRESCULPTURES.
In case of consignment delivery, it is the customer's responsibility to protect the products against damage (breakage, theft).
The risk for loss or damage passes to the customer once he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods. However, the risk is already transferred to the customer upon delivery to the carrier, if the carrier has been instructed by the customer to transport the goods and this choice was not offered by DIRKDUPRESCULPTURES.
Right of withdrawal
The provisions of this article only apply to Customers in their capacity as consumers when purchasing online sculptures from DIRKDUPRESCULPTURES. If the right of withdrawal applies:
the Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the good.
To exercise the right of withdrawal, the Customer must inform DIRKDUPRESCULPTURES of his decision to withdraw from the contract by an unequivocal statement. This can be done via the email address: info@dupre.be.
If the Customer makes use of this option, we will immediately send the Customer (by e-mail) a confirmation of receipt of his withdrawal. To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired. The Customer must return or hand over the sculptures to DIRKDUPRESCULPTURES without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to DIRKDUPRESCULPTURES. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The costs incurred for returning the goods will be borne by the Customer. The Customer is requested to return the items in their original condition and packaging.
If the returned sculpture has been reduced in value in any way, DIRKDUPRESCULPTURES reserves the right to hold the Customer liable and claim compensation for any reduction in value of the goods resulting from the handling of the goods by the Customer.
All returned items will be carefully examined. The basic principle here is that the consumer may only inspect the item as he would in a store.
If an item has suffered a reduction in value due to the use of the Customer, this will be charged to the Customer.
If the Customer revokes the agreement, DIRKDUPRESCULPTURES will refund all payments received from the Customer up to that time, including standard delivery costs, to the Customer within a maximum of 14 calendar days after DIRKDUPRESCULPTURES has been informed of the Customer's decision to terminate the agreement. revoked. For sales contracts, DIRKDUPRESCULPTURES may withhold reimbursement until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first. Any additional costs resulting from the Customer's choice of a method of delivery other than standard delivery will not be refunded. DIRKDUPRESCULPTURES will reimburse the Customer using the same payment method with which the Customer performed the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any costs for such reimbursement.
Penalties for non-payment
Without prejudice to the exercise of other rights available to DIRKDUPRESCULPTURES, in the event of non-payment or late payment, the Customer is legally liable to pay interest of 10% per year on the unpaid amount from the date of the default and without notice. In addition, the Customer is legally liable and without notice to pay a lump sum compensation of 10% on the amount concerned, with a minimum of 100 euros per invoice. Without prejudice to the foregoing, DIRKDUPRESCULPTURES reserves the right to take back items that have not been (fully) paid for.

Applicable law
In case of disputes Belgian law applies, with the exception of the provisions of private international law regarding applicable law. The courts of the Consumer's place of residence have jurisdiction in legal disputes.
